Why did Shilpa Shetty’s husband Raj Kundra get bail in porn films case despite serious charges against him? Know here

Shilpa Shetty’s husband Raj Kundra was granted bail on Monday (September 2021) after spending two months in jail in connection with the pornography racket case. The Mumbai court granted him bail on a surety of Rs 50,000. The court has also granted bail to Kundra’s associate Ryan Thorpe. He will also have to furnish a surety of Rs 50,000.
Raj Kundra is facing serious allegations and is booked under Indian Penal Code Sections 420 (cheating), 34 (common intention), 292, and 293 (related to obscene and indecent advertisements and displays), and relevant sections of the IT Act and the Indecent Representation of Women (Prohibition) Act.
Despite such serious charges against him, you must be wondering how did Kundra get bail. A per an ETimes report, it was observed by the metropolitan magistrate court in Mumbai that, ‘only on the ground that further investigation is going on, the accused cannot be kept behind bars till the conclusion of trial’.
As per the report, the court also said in the detailed order that ‘the statements of all witnesses were recorded under section 164 of the Code Of Criminal Procedure’. Furthermore, it is believed by the court that ‘the possibility of tampering with evidence was less as all the laptops and mobile phones of Viaan Industries that were seized are in the custody of the police. The report from a cyber expert is still being awaited. At present, the investigation is completed as the chargesheet is filed on Sept 15’. 
Raj, however, will have to abide by a few conditions imposed by the court including that he will not tamper with evidence. The businessman will also have to inform the police about any change in his residential address or contact details. As per the order, Kundra will also not leave India. If he wishes to, prior permission from the court shall be taken.
While speaking to Etimes, Kundra’s lawyer had shared, “Investigation was over and the charge sheet was filed and now further custody was not required. The court ruled that since the charge sheet was filed and as it had already ruled that videos in question were shot with the consent of adult women, there was no need to keep the accused behind bars.”
He added, “We explained that celebrities have control over their apps and the platform is not responsible for its content.”   

Kundra was arrested by police on July 19 along with 11 other people on charges related to the alleged creation of pornographic films.
